Katharagama 410px 14 09 12Though all devalayas are required to pay income tax in accordance with the Temple and Devala Lands Act, the Kataragama Devalaya has not done so since the year of 2009,  reports say.

In 2009, the Kataragama Devalaya was released from the above Act and by then the Basnayaka Nilame position was held by Shashindra Rajapaksa, who was also appointed as Uva Chief minister in the same year.

However, according to the above Act, the post of the Kataragama Devalaya Basnayaka Nilame and the post of the Uva Chief minister cannot be simultaneously held by the same person.

Measures were taken by President Mahinda Rajapaksa to overcome this legal barrier by removing the Kataragama Devalaya from the Temple and Devala Lands Act.

Though the above Act makes it mandatory for all devalayas to provide details pertaining to income and tax payments to the Public Trustee Department, with its removal in 2009, the Kataragama Devalaya has stopped doing so.
